Have you been to the movies lately? No doubt you’ve seen the cinema’s request to keep those cell phones off, or at least on silent. And chances are high that at least one person ignored the request while the movie is playing.
Round Rock’s Brandon Vezmar was so fed up with someone texting during “Guardians of the Galaxy, Vol. 2” he filed a petition in small claims court for damages. But this wasn’t a total stranger. It was his date. Their first date.
Vezmar is seeking $17.31 in damages. While he admits the amount is quite small – it’s what he spent to take her to a 3-D showing of the movie – he says it’s the principle of the matter.
Not only was he distracted by her texting, he felt other moviegoers were affected by her cell phone use. In fact, he described the defendant’s behavior as a “threat to civilized society.” He estimated that she activated her phone between 10-20 times during a span of 15 minutes.
The woman did have a defense. She told the Austin American-Statesman, she was texting a friend who needed her.
