Attorneys who handle medical malpractice cases know all too well the frustrations, expense, and the enormous amount of time these types of cases require. Our experience is no different.

The Harris Firm is representing Mr. Bell, who nearly died after his dentists failed (twice!) to disclose that he had periodontitis, an infection of the gums. In his case, this infection migrated from his mouth to his heart, causing severe damage to his heart. A quick-thinking internist, a Care-Flite, and emergency heart surgery at Presbyterian Dallas saved Mr. Bell’s life.

As difficult as that surgery and recovery was for Mr. Bell and his family, it would only get worse after he decided to sue Dr. Markham and Dr. Lynch of The McKinney Dentist for malpractice.

  • We provided expert testimony that the dentists involved failed to fulfill their duties to Mr. Bell.
  • The defendants tried to get our expert testimony dismissed. A judge took this under advisement and after a lengthy period, ruled in our favor.
  • The defendants appealed that decision, and after a lengthy delay, the Court of Appeals overturned the trial court decision and remanded the case back to that court.
  • We filed an amended report to fulfill the deficiencies noted by the Court of Appeals, and once again, the defendants filed another motion to strike. This time, they were successful and the Court struck the report.
  • Now, it was our turn to appeal and we argued before the Court of Appeals this past November. On January 30th, the Court ruled in our favor. The report with our expert testimony was deemed adequate.
  • Guess what? The defendant can take additional steps in the Court of Appeals and keep this lawsuit tied up even longer.

We will never stop fighting for Mr. Bell. Had his dentists been less interested in selling our client expensive implants, and more interested in basic care, his near-death experience could have been completely avoided.

But as you have read, this is why most attorneys don’t take medical malpractice cases. Almost four years down this road, we’re one step closer to a trial.
