It was hard to miss Monday’s news about the home that exploded in a subdivision in Waxahachie. What was once a new, beautiful home is now lost in a pile of brick, lumber, and personal effects. Our thoughts and prayers go out to the three people who were injured as well as the other home owners who were evacuated from their homes. Fox 4 News reports Atmos Energy as saying, the explosion was caused by a damaged gas line and sewer line. It was apparently caused by a construction crew though no other specifics were available. So what happens in this type of life-changing event? Since a gas leak was purportedly proven to be the cause, does this family, and do those in the neighborhood who suffered losses have the right to seek the recovery of damages – which may include lost property, home re-building/repair, and damages associated with physical injuries (including, but not limited to health care expenses)? The answer is yes. Now just who exactly is responsible and who will have to pay is, as yet, unclear, but there may be various parties who could be held responsible. I would strongly encourage anyone associated with this, or other similar situations, to seek legal counsel to guide them on what claims he or she might have. Whether your home is older or brand new, if something has gone wrong and caused some type of injury or damage, you can at least seek to recoup that cost. Not sure if you have a case?
