Early Sunday, police, Dallas County Sheriff’s Department and EMT’s responded to an accident off an I-35 exit. An SUV with two adults and three children inside veered off the road and rolled over. Thankfully, everyone survived. The passenger suffered a fracture and a head injury – but everyone else appeared to be okay.
According to the driver, she hit a pothole on the Commerce Street exit causing her to veer off the road. While the sheriff’s department will investigate the incident, let’s assume the driver’s version is accurate. If an accident is caused by hitting a pothole, can you sue the City of Dallas for not maintaining a safe road?
While a growing number of people are moving to DFW, and we’re certainly seeing more wear and tear on our roads and highways, Texas law says its cities are not responsible for damage caused by debris or potholes.
The Texas Department of Transportation website does have a formal process where you can make a claim seeking reimbursement. But you should know, the chances of getting any kind of refund are very rare.
